1. ACCEPTANCE OF TERMS
These Terms & Conditions (“Terms”) constitute a legally binding agreement between Ananya Child Development and Early Intervention Clinic (“Ananya,” “we,” “our,” or “the Centre”) and the parent, legal guardian, or authorised representative (“you,” “parent,” or “client”) of the child receiving services.
Binding Agreement: By completing the onboarding process, submitting forms, making payments, attending sessions, or utilising any services offered by Ananya, you acknowledge that you have read, understood, and agreed to these Terms in their entirety.

Parental Consent for Child Data: By accepting these Terms, you provide verifiable consent for the collection and processing of your child’s personal data as required under the Digital Personal Data Protection Act, 2023.
2. SERVICE DESCRIPTIONS & SCOPE
Ananya provides evidence-based early intervention and therapeutic services for children with developmental delays, neurodevelopmental conditions, and related challenges. Our services are designed to support child development, enhance functional skills, and empower families.
Ananya operates as an integrated multidisciplinary team. Parents cannot select, request, or refuse specific therapists. All therapist assignments are determined by Ananya’s clinical management based on child needs, therapist expertise, scheduling logistics, and internal operational considerations. This non-negotiable policy ensures equitable service delivery, optimal caseload distribution, and professional clinical decision-making. Detailed provisions regarding therapist assignment are outlined in Section 6.2.

Description: Ananya offers online therapy services via secure video consultation platforms (Zoom, Google Meet, or other approved platforms) for clients across India and
internationally.

Important Disclaimer: Online therapy effectiveness may vary compared to in-person
services. Some therapeutic modalities may be limited in online format. We do not
guarantee equivalent outcomes between in-person and online services. Clinical decisions
about service delivery mode rest solely with Ananya therapists.
International Clients: For clients located outside India, applicable laws and regulations of your jurisdiction may apply in addition to Indian law. Parents are responsible for ensuring compliance with local healthcare and data protection regulations.
2.3 Mission Talk Programme
Description: Mission Talk is a structured communication therapy programme designed to
support children with speech and language challenges.
Eligibility: Determined by clinical assessment and therapist recommendation.
2.4 Institutional Training and Consultation
Ananya offers training programmes for educators, healthcare professionals, and
organisations. Separate terms apply to institutional contracts.
3. ELIGIBILITY & ADMISSION CRITERIA
3.1 Eligibility Requirements
To access Ananya’s services, families must meet the following criteria:

5. Service Commencement: Therapy sessions begin upon completion of the admission
process and payment of applicable fees.
Important: Sessions will not commence until all onboarding forms are submitted and
advance fees are paid (at least 48 hours prior).
3.3 Waitlist Policy

Due to high demand, Ananya may maintain a waitlist for certain services. Waitlist positions do not guarantee admission. Parents will be notified when slots become available.
4. FEES, PAYMENT TERMS, REFUND POLICY
4.1 Fee Structure
Ananya operates on a premium service model to ensure the highest quality of care, experienced professionals, and evidence-based interventions. Our fee structure reflects our
commitment to clinical excellence and comprehensive family support.
Fee Transparency: Detailed fee schedules are provided during the consultation, report
discussion or admission process. Fees are subject to change with 30 days’ prior notice.
Fee Variability: Fees vary by service type, therapy intensity, branch location,
and program duration. We offer both monthly and quarterly payment packages.
Quarterly packages typically include a discount as recognition of the parent’s
commitment to their child’s therapeutic progress.
Discount Non-Transferability: Any discount, concession, or promotional pricing
granted on a specific therapy program or frequency is valid only for that exact
service configuration. If a client changes therapy type, reduces session frequency,
switches branches, or resumes services after a break exceeding 30 days, the
original discounted rate expires and standard pricing applies. Discounts cannot
be carried forward, transferred between programs, or reinstated without fresh
approval from the accounts team. This policy ensures pricing integrity and
prevents administrative disputes.
4.2 Payment Terms

Payment Gateway: We use third-party payment gateways for digital transactions. Payment processing is governed by the gateway’s terms and privacy policies, for which Ananya is not
liable.
Late Payment: Failure to make timely payments may result in fine, suspension or termination of services (see Section 10).
4.3 Refund Policy
Critical Policy: Due to the nature of therapeutic services, advance scheduling, and resource
allocation, Ananya operates a strict no-refund policy under the following circumstances:

Refund Processing Time: Approved refunds will be processed within 15 working days via NEFT/bank transfer.
No Chargeback Abuse: Parents agree not to initiate chargebacks or payment disputes for services that do not qualify for refunds under this policy. Fraudulent chargebacks may result in termination of services and legal action.
4.4 Fee Adjustment for Service Modifications
Mid-Cycle Program Changes:
If a child’s therapy plan changes mid-cycle due to clinical recommendation (e.g., frequency reduction, modality change, branch transfer), fees will be adjusted on a pro-rated basis for the next billing cycle only. No retroactive refunds or credits will be issued for the current billing cycle.
Discount Forfeiture Upon Modification:
Any discount, promotional pricing, or special rate granted on the original therapy program becomes void if the service configuration changes. This includes:
Upon service modification, standard non-discounted pricing applies to the new
configuration. Clients wishing to negotiate a new discount must submit a fresh
request to the accounts team, which will be evaluated independently without
reference to previous pricing.
No Discount Carry-Forward:
Discounts are program-specific and time-bound. A discount granted on a quarterly
package (e.g., “10% off for Q1 2026”) does not automatically apply to subsequent
quarters. Each billing cycle is priced independently unless a multi-cycle agreement
is explicitly documented in writing.
Example Scenario:
Client books quarterly package (Jan-Mar 2026) with 15% discount for commitment.
In February, child’s needs change and frequency reduces from 12 to 8 sessions/month.
Result: 15% discount is void. March billing reflects standard pricing for
8 sessions/month. Client cannot claim “I already got the discount for the full
quarter.”
Resumption After Break:
If a client pauses services (formally or due to non-payment) and later resumes,
any previous discounts or promotional rates are considered expired. Resumption
pricing follows the current standard fee schedule at the time of re-enrolment.
Administrative Authority:
All fee adjustment decisions rest with the accounts team. Therapists, coordinators,
and front-desk staff are not authorized to modify fees, extend discounts, or make
pricing commitments. Only written confirmation from the accounts team constitutes
a valid pricing agreement.
5. APPOINTMENT SCHEDULING & CANCELLATIONS
5.1 Scheduling Process

“completed,” and no refunds or make-up sessions will be provided.

5.5 Compensation Sessions and Missed Session Policy
General Principle: Therapy sessions operate on a fixed schedule similar to educational institutions, fitness facilities, and medical appointments. Missed sessions due to client unavailability are the client’s responsibility and do not automatically entitle clients to make-up sessions or extensions of service validity.
Compensation Session Eligibility:
Clients may request compensation sessions (rescheduled sessions for pre-informed cancellations) under the following strict conditions:
1. Maximum Limit: Up to 4 compensation sessions per calendar month (or 16 per quarterly cycle if on quarterly package), subject to slot availability.
2. Advance Notice Required: Client must provide at least 48 hours’ advance written notice of cancellation (as per Section 5.2).
3. Legitimate Absence: Compensation sessions are granted at Ananya’s discretion
for documented legitimate absences only, including:
– Child illness (medical certificate may be requested)
– Family emergencies (documentation required)
– Unavoidable circumstances beyond client control
4. Availability-Based: Compensation sessions are scheduled based on slot
availability, typically on Saturdays only. Ananya does not guarantee specific
dates or times for compensation sessions.
5. Same Therapist Not Guaranteed: Compensation sessions may be conducted by a
different therapist if the primary therapist is unavailable.
Critical Limitations:
No Carry-Forward: Missed sessions from one calendar month, billing cycle, or term cannot be carried forward to the next month, billing cycle, or term under any circumstances. Each month/term operates as an independent service period. Unused compensation session entitlements expire at the end of each billing cycle.
No Fee Extensions: Compensation sessions do not extend the validity period of
monthly or quarterly packages. If a client has paid for “January 2026 services,”
compensation sessions must be scheduled and completed within January 2026. The
service period does not extend to February 2026 regardless of unused sessions.
No Refund Substitution: Compensation sessions cannot be converted into refunds, credits, or discounts on future services.
Abuse Prevention: Clients who repeatedly request compensation sessions (more
than 50% of scheduled sessions cancelled in any 60-day period) may be deemed
uncommitted to therapy and may face service termination as per Section 10.2.
No Negotiation Leverage: Missed sessions or unused compensation session
entitlements cannot be used to negotiate fee reductions, payment delays, or service modifications. Fees are due in full regardless of attendance patterns.
Administrative Discretion: Final determination of compensation session eligibility, scheduling, and legitimacy rests solely with Ananya’s administrative
team. This decision is not subject to appeal or arbitration.
CLIENT RESPONSIBILITIES & CODE OF CONDUCT

choosing from a menu of service providers.

Important Clarification:
This policy does not prevent parents from requesting therapist changes for legitimate
clinical concerns (e.g., “therapist seems unfamiliar with my child’s diagnosis,”
“communication style is ineffective”). Such concerns should be raised with management and
will be evaluated on a case-by-case basis. However, requests framed as personal
preferences (“I only want Therapist X”), convenience (“Therapist Y’s schedule suits me
better”), or attempts to control staffing decisions will be declined.

Ananya maintains a Zero Tolerance Policy for the following behaviours:
Consequences: Violation of the Zero Tolerance Policy may result in immediate termination of services, forfeiture of all advance fees, and potential legal action.
6.6 Unilateral Recording Prohibition
Parents can not record therapy sessions (video or audio) without prior written consent from Ananya. Unauthorised recording violates therapist intellectual property rights, confidentiality protocols, and professional boundaries.
Exceptions: Recording may be permitted for specific clinical purposes (e.g., home practice review) with advance written approval.
7. INTELLECTUAL PROPERTY RIGHTS
7.1 Ownership of Materials
All therapy materials, assessment tools, training resources, and parent education content are the exclusive intellectual property of Ananya Child Development and Early Intervention
Clinic.

7.2 Clinical Records and Reports
Assessment reports, progress notes, and therapy documentation prepared by Ananya professionals remain the intellectual property of the Centre. Parents may receive copies for personal use but cannot share them publicly or commercially without written consent.
8. LIMITATION OF LIABILITY & DISCLAIMERS
8.1 No Guaranteed Outcomes
Ananya provides evidence-based therapeutic interventions designed to support child
development. However, we do not guarantee specific developmental outcomes, cures, or improvements.
Factors Affecting Outcomes:
No Misrepresentation: We do not promise, imply, or advertise guaranteed “cures,”
“miraculous improvements,” or “elimination of disability.” Such claims would violate the
Consumer Protection Act, 2019 and Advertising Standards Council of India (ASCI) guidelines.

9. CONFIDENTIALITY & PROFESSIONAL BOUNDARIES
9.1 Therapist-Client Confidentiality
All clinical information shared during therapy sessions is confidential and protected under
professional ethics standards. Therapists will not disclose client information without
parental consent, except:

CCTV surveillance is in place for child safety, staff protection, and security purposes. CCTV footage is not accessible to clients under any circumstances, except where legally mandated by court order or law enforcement.

10. TERMINATION & SUSPENSION RIGHTS
10.1 Client-Initiated Termination
Parents may terminate services at any time by providing written notice to Ananya. However:

11. DISPUTE RESOLUTION & GOVERNING LAW
11.1 Governing Law
These Terms are governed by the laws of India, specifically:
Jurisdiction: Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Hyderabad, Telangana, India.
11.2 Mandatory Arbitration
Before initiating litigation, parties agree to attempt resolution through binding arbitration in Hyderabad, Telangana, in accordance with the Arbitration and Conciliation Act, 1996.

14. SEVERABILITY CLAUSE
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall continue in full force and effect.
